Terms and Conditions

These Terms and Conditions govern the use of the SoumissionsFunéraires.ca platform ("the Platform", "we", "our"). By submitting a quote request or using our services, you ("the User") acknowledge that you have read, understood and accepted these terms, as well as our Privacy Policy.

1. Nature of the service

The Platform is a free matching service for families. We collect the information related to your request and transmit it to a limited number (maximum 4) of partner funeral homes matching your region and needs.

Partner funeral homes are independent businesses holding a valid licence issued by Quebec's Ministry of Health and Social Services (MSSS). They are solely responsible for the nature, quality, price and delivery of the funeral services they offer.

2. Intermediary role — no mandate or representation

SoumissionsFunéraires.ca acts solely as a technological intermediary. We:

• Do not act as a mandatary, broker, agent or representative of partner funeral homes;
• Do not act as a mandatary, advisor or representative of families;
• Are not a party to any funeral contract entered into between a family and the chosen funeral home;
• Do not collect any payment from families — our compensation comes exclusively from a commission paid by the partner funeral home upon conversion.

Nothing in these terms or in any communication from us shall be construed as creating a relationship of mandate, partnership, employment or franchise between us and any partner funeral home or User.

3. No liability for services rendered

The User expressly acknowledges and accepts that:

• We assume no liability for funeral services rendered (or not rendered) by partner funeral homes, nor for the quality, content, price, timing, compliance or any other aspect of those services;
• We do not guarantee that a partner funeral home will respond to your request, that a quote will be sent to you, or that quoted prices will match the final quote;
• Any dispute concerning the provision of a funeral service (quality, performance, billing, failure) must be resolved directly with the funeral home concerned, which remains solely responsible;
• We are not responsible for the acts, omissions, statements or conduct of partner funeral homes, whether before, during or after the provision of services.

4. User commitments

By using the Platform, you agree to:

• Provide accurate, complete and up-to-date information;
• Not submit fraudulent, abusive or bad-faith requests;
• Use the Platform only for personal, lawful purposes consistent with its intended use;
• Not attempt to access non-public parts of the Platform, extract data automatically, or disrupt its operation;
• Respect the intellectual property rights of the Platform and third parties.

5. Intellectual property

All content on the Platform — text, graphics, logos, icons, images, audio, source code, structured data and layout — is the property of SoumissionsFunéraires.ca or its licensors and is protected by Canadian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display or commercially exploit any portion of this content without our prior written authorization.

6. Limitation of liability

To the fullest extent permitted by applicable law, SoumissionsFunéraires.ca, its officers, employees and subcontractors shall not be liable for any direct, indirect, incidental, consequential, special or exemplary damages (including, without limitation, loss of profits, data, goodwill or emotional distress) arising from:

• The use of or inability to use the Platform;
• Services rendered or not rendered by a partner funeral home;
• Any dispute between you and a partner funeral home;
• Any inaccuracy, error or omission in information provided by a partner funeral home (price, availability, services offered, etc.);
• Any temporary or prolonged interruption of the Platform.

Should our liability nonetheless be engaged, it is limited, per User, to the total amount received (if any) from that User over the preceding twelve (12) months, it being understood that families make no payment to the Platform.

7. Communications and request form

By submitting the quote request form, you consent to your contact details and request information being transmitted to the selected partner funeral homes, and you agree to receive communications from us and from partner funeral homes related to your request, by the means you have indicated (email and/or phone).

You may withdraw your consent at any time by emailing confidentialite@soumissionsfuneraires.ca.

8. Third-party links

The Platform may contain links to third-party sites (notably to partner funeral home websites). Those sites are governed by their own terms and policies. We are not responsible for their content, accuracy or practices.

9. Changes

We may amend these terms at any time. The current version is always dated and available at this address. Continued use of the Platform after a change constitutes acceptance of the new terms.

10. Governing law and jurisdiction

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute concerning their interpretation or performance shall be submitted to the competent courts of the judicial district of Montreal (Quebec), to the exclusion of any other court, subject to the mandatory provisions of consumer protection law.

11. Severability

If any provision of these terms is held invalid or unenforceable by a competent court, the remaining provisions shall remain in force.
