Terms and Conditions

These Terms and Conditions govern the use of the SoumissionsFunéraires.ca platform ("the Platform"), operated by 9565-5049 QUÉBEC INC., a corporation duly constituted under the Business Corporations Act (Quebec) ("we", "our"). By submitting a quote request or using our services, you ("the User") acknowledge that you have read, understood and accepted these terms, as well as our Privacy Policy.

1. Nature of the service

The Platform is a free matching service for families. We collect the information related to your request and transmit it to a limited number of partner funeral services businesses matching your region and needs.

Partner funeral services businesses are independent businesses. They declare that they hold the permits and authorizations required to offer their services, including any permit issued by Santé Québec or Quebec's Ministry of Health and Social Services (MSSS). We may carry out certain verifications, but it is also up to the User to verify the permits, qualifications and authorizations of the business they choose before entering into a contract.

2. Intermediary role — no mandate or representation

SoumissionsFunéraires.ca acts solely as a technological intermediary. We:

• Do not act as a mandatary, broker, agent or representative of partner funeral services businesses;
• Do not act as a mandatary, advisor or representative of families;
• Are not a party to any funeral contract entered into between a family and the chosen funeral services business;
• Do not set the prices or the terms of the services offered by partner funeral services businesses. Unless the business concerned indicates otherwise, the prices, estimates and service information displayed on the Platform or transmitted through it are provided for information purposes only and may be preliminary. Only the contract entered into directly between the User and the funeral services business determines the nature, price and final terms of the funeral services;
• Do not collect any payment from families — our compensation comes exclusively from partner funeral services businesses, in consideration of our role as intermediary. The selection of a partner funeral services business and the transmission of a request to it do not constitute a recommendation, an endorsement or a guarantee on our part. It is up to the User to compare the quotes received, verify the information provided and determine whether the proposed services meet their needs before entering into a contract.

Nothing in these terms or in any communication from us shall be construed as creating a relationship of mandate, partnership, employment or franchise between us and any partner funeral services business or User.

3. No liability for services rendered

The User expressly acknowledges and accepts that:

• We assume no liability for funeral services rendered (or not rendered) by partner funeral services businesses, nor for the quality, content, price, timing, compliance or any other aspect of those services;
• We do not guarantee that a partner funeral services business will respond to your request, or that a quote will be sent to you;
• Any dispute concerning the provision of a funeral service (quality, performance, billing, failure) must be resolved directly with the funeral services business concerned, which remains solely responsible;
• We are not responsible for the acts, omissions, statements or conduct of partner funeral services businesses, whether they occur before, during or after the provision of services.

4. User commitments

By using the Platform, you agree to:

• Provide accurate, complete and up-to-date information;
• Not submit fraudulent, abusive or bad-faith requests;
• Not submit a request without a genuine intention to obtain funeral services;
• Use the Platform only for personal, lawful purposes consistent with its intended use;
• Not attempt to access non-public parts of the Platform, extract data automatically, or disrupt its operation;
• Respect the intellectual property rights applicable to the Platform's content as well as those of third parties.

5. Intellectual property

All content on the Platform — text, graphics, logos, icons, images, audio, source code, structured data and layout — is our property or that of our licensors and is protected by Canadian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display or commercially exploit any portion of this content without our prior written authorization.

6. Limitation of liability

To the fullest extent permitted by applicable law, neither we nor our officers, employees or subcontractors shall be liable for any indirect, incidental, consequential, special or exemplary damages (including, without limitation, loss of profits, data or goodwill) arising from:

• The use of or inability to use the Platform;
• Services rendered or not rendered by a partner funeral services business;
• Any dispute between you and a partner funeral services business;
• Any inaccuracy, error or omission in information provided by a partner funeral services business (price, availability, services offered, etc.);
• Any temporary or prolonged interruption of the Platform.

Subject to the mandatory provisions of applicable law, should our liability nonetheless be engaged in connection with a particular request, our total liability is limited to the greater of the following amounts: (a) the compensation we actually received from a partner funeral services business in connection with that request; or (b) $100.

Nothing in these Terms is intended to exclude or limit our liability in the event of intentional or gross fault, for bodily or moral injury, or in any other case where such an exclusion or limitation is prohibited by law.

7. Communications and request form

By submitting the quote request form, you consent to your contact details and request information being transmitted to the selected partner funeral services businesses in accordance with our Privacy Policy, and you agree to receive communications from us and from partner funeral services businesses related to your request, by the means you have indicated (email and/or phone). We strive to transmit requests to the selected partner funeral services businesses as soon as possible, generally within 24 hours. This time frame is indicative only and may be extended due to circumstances beyond our control. We do not control how quickly a partner funeral services business will contact you.

You may withdraw your consent for the future at any time by emailing info@soumissionsfuneraires.ca.

Withdrawing consent does not affect communications already made and may prevent us from continuing to process your request. Once your information has been transmitted to a partner funeral services business, you will need to contact that business directly to exercise your rights with respect to it.

8. Third-party links

The Platform may contain links to third-party sites (notably to the websites of partner funeral services businesses). Those sites are governed by their own terms and policies. We are not responsible for their content, accuracy or practices.

9. Changes

We may amend these Terms from time to time. The date of the last update is indicated at the beginning of the document. Amendments apply only to requests submitted and uses of the Platform after they come into force, unless the law permits or requires otherwise.

10. Governing law and jurisdiction

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute concerning their interpretation or performance shall be submitted to the competent courts of the judicial district of Montreal (Quebec), to the exclusion of any other court, subject to the mandatory provisions of consumer protection law.

11. Severability

If any provision of these terms is held invalid or unenforceable by a competent court, the remaining provisions shall remain in force.
